$500,000 Settlement

Case summary Case type: Slip and fall (premises liability) Insurance company first offer: $170,000 Final recovery: $500,000 The insurer first offered $170,000 to resolve this slip and fall claim. AK Injury Law Firm continued to build the case and the client recovered $500,000, about 2.9 times the first offer. How we handle slip and fall cases In a California premises liability case, the injured person generally must show that the property owner or manager knew, or should have known, about a dangerous condition and failed to repair it or warn visitors. We move quickly to preserve incident reports, surveillance video, photos of the hazard, maintenance and inspection logs, and witness information, because this evidence can disappear fast. Claims against a city, county or other public entity have a much shorter deadline: a government claim usually must be filed within six months (California Government Code section 911.2). Rideshare Accidents How Uber and Lyfts Three Coverage Periods Decide Your Claim

Rideshare Accidents: How Uber and Lyft’s Three Coverage Periods Decide Your Claim

Uber and Lyft accidents can look like ordinary car crashes from the outside. Two vehicles collide, someone is injured, and an insurance claim follows. Behind the scenes, however, determining which insurance policy applies can be considerably more complicated. The reason is that rideshare insurance changes according to what the driver was doing in the app at the exact moment of the collision. A driver who has the Uber or Lyft app turned off is in a very different insurance position from a driver who is logged in and waiting for a passenger. Coverage changes again after the driver accepts a ride, and another important set of protections applies once the passenger enters the vehicle. California divides transportation network company activity into three primary coverage periods. For an accident victim, determining the correct period can affect which insurer receives the claim, how much liability coverage may be available, whether uninsured or underinsured motorist coverage applies, and how the case should be investigated. That is why one of the first questions after a rideshare collision should be: What was the Uber or Lyft driver’s exact app status when the crash happened? What Are the Three Uber and Lyft Insurance Periods? California regulates companies such as Uber and Lyft as transportation network companies, commonly called TNCs. The state’s insurance framework separates rideshare activity according to the driver’s relationship with the app and passenger. Period 1: The driver is logged into the rideshare app and available to receive a request, but has not yet accepted a passenger. Period 2: The driver has accepted a ride and is traveling to pick up the passenger. Period 3: The passenger has entered the vehicle and the ride continues until the passenger exits. There is also an important situation that comes before Period 1: the app is completely off. When the driver is not using the rideshare platform, the driver’s ordinary personal automobile insurance generally becomes the primary insurance to examine. These distinctions may sound technical, but they can have major consequences after a serious crash. What Happens When the Uber or Lyft App Is Off? If a rideshare driver is operating the vehicle for personal purposes and is not logged into Uber or Lyft, the accident generally begins like any other collision involving a private motorist. The driver’s personal automobile insurance is the primary policy to investigate. For example, suppose an Uber driver finishes working, logs out of the application, and drives to a grocery store. If the driver causes a collision on that personal trip, Uber’s rideshare liability coverage generally would not apply simply because the person happens to work as an Uber driver. The critical issue is what the driver was doing at the moment of the crash, not whether the driver has an Uber or Lyft account. This makes evidence about app status extremely important. A driver might tell someone at the scene that they were “working,” but that description does not establish the specific rideshare period. Conversely, a driver may say they were not carrying a passenger even though they had already accepted a request and were traveling toward the pickup location. The precise electronic data can matter more than casual statements made after the collision. How Does Period 1 Coverage Work? Period 1 begins when the rideshare driver logs into the platform and is available to accept a passenger request but has not yet accepted one. Under current California requirements, TNC insurance during this period must provide at least: $50,000 for death or personal injury to one person; $100,000 for death or personal injury per incident; and $30,000 for property damage. California also requires at least $200,000 in excess coverage per occurrence during this period for qualifying liability exceeding the primary Period 1 limits. Period 1 is important because personal automobile policies frequently contain restrictions or exclusions involving commercial or rideshare activity. A driver should not assume that a standard personal policy will provide ordinary coverage once the rideshare application is active. For someone injured by a rideshare driver during Period 1, identifying the driver’s status can therefore reveal insurance protection that may not be obvious from the insurance card exchanged at the scene. Why Can Period 1 Cause Insurance Disputes? Period 1 sits between personal driving and an active passenger trip. The driver is working through the platform in the sense that the app is active, but there is no accepted ride and no passenger yet. Historically, that transition created significant uncertainty between personal and commercial insurance, which is one reason California established specific TNC insurance requirements. Imagine a Lyft driver is parked while waiting for a request. The driver begins moving toward a busier part of town while remaining logged into the Lyft platform and causes a collision before receiving a ride request. There is no passenger. There is no accepted trip. But the driver is not simply using the vehicle privately either. That situation generally falls within Period 1. If an injured person reports the collision only to the driver’s personal insurer without investigating the rideshare activity, important coverage information may be missed. What Is Period 2 in an Uber or Lyft Accident? Period 2 begins when a rideshare driver accepts a passenger’s request and continues while the driver travels to the passenger’s pickup location. This period is particularly important because the level of required liability coverage rises substantially. Under current California law, once the driver accepts the ride request, transportation network company insurance must provide primary coverage of $1 million for death, personal injury, and property damage, subject to the policy and applicable law. The passenger does not need to be physically inside the Uber or Lyft vehicle for this primary liability requirement to begin. That point can be extremely important after a serious collision. Suppose an Uber driver accepts a ride at the airport and causes an accident while traveling toward the passenger’s pickup point. Even though the passenger has not yet entered the vehicle, the accepted request has moved the driver from Period 1 into

Diminished Value Claims: Getting Paid for What Your Car Is Worth Now

Getting your vehicle repaired after a car accident does not necessarily make you financially whole. A body shop may replace damaged panels, straighten structural components, repaint the vehicle, and restore it to safe operating condition, yet the vehicle may still be worth less than it was immediately before the crash. Why? Because accident history matters to buyers, dealerships, and appraisers. A vehicle that has been involved in a significant collision may be harder to sell or trade, even when the repairs were completed correctly. Prospective buyers can review vehicle history reports, dealers may reduce trade-in offers, and purchasers may prefer a similar vehicle with no accident history. The difference between what your vehicle was worth before the collision and what it is reasonably worth afterward may form the basis of a diminished value claim. For California accident victims, diminished value can be an important part of a property damage claim, particularly when the vehicle is relatively new, valuable, low mileage, well maintained, or suffered substantial collision damage. The key is proving that the accident caused an actual measurable loss in market value rather than simply asserting that the car is now worth less. What Is Diminished Value After a Car Accident? Diminished value is the reduction in a vehicle’s fair market value caused by its accident history or by damage that cannot be completely eliminated through repairs. Imagine two vehicles that are otherwise nearly identical. They are the same year, make, model, trim level, mileage, and condition. One has never been involved in a collision. The other sustained significant accident damage and required extensive body and structural repairs. If buyers consistently pay less for the vehicle with the accident history, that difference can represent diminished value. The important point is that diminished value is separate from the cost of repairing the vehicle. Repair costs compensate for the physical work needed to restore the damaged car. A diminished value claim addresses the economic loss that may remain after those repairs have been completed. California’s civil jury instructions recognize that when personal property such as an automobile can be repaired but is still worth less after the repairs, damages may include the reasonable repair cost together with the remaining difference in value, subject to applicable limits. What Are the Different Types of Diminished Value? Diminished value is often divided into several categories. Understanding the difference can help clarify what an accident victim is actually claiming. Inherent diminished value: The reduction in market value caused simply by the vehicle having a documented accident history, even after competent repairs have been completed. Repair-related diminished value: Additional loss caused by incomplete, improper, visibly inferior, or otherwise inadequate repairs. Immediate diminished value: The difference between the vehicle’s value immediately before the accident and its value immediately after the accident but before repairs are completed. Most post-repair diminished value disputes focus on inherent diminished value. The owner is not necessarily claiming that the repair shop did poor work. The argument is that the marketplace treats a previously damaged vehicle differently from an otherwise comparable vehicle with a clean accident history. Can I Make a Diminished Value Claim in California? Potentially, depending on how the accident occurred, who was responsible, the nature of the damage, the available evidence, and whether the claim is against another driver’s insurer or your own insurance company. California law generally measures damage to personal property by the economic loss caused by the wrongdoing. When a vehicle can be repaired but remains less valuable afterward, California’s civil jury instructions recognize a potential measure of damages that accounts for both the reasonable repairs and the remaining reduction in value. That makes a third-party diminished value claim particularly important to investigate when another driver’s negligence damaged your vehicle. The situation can be different when you seek diminished value directly from your own collision insurer. Your rights against your own carrier are governed heavily by the insurance contract. California courts have held that certain policy language can allow an insurer to satisfy its contractual obligation by restoring the vehicle to its pre-accident safe, mechanical, and cosmetic condition without separately paying for the market stigma that remains afterward. For that reason, it is important to distinguish a liability claim against the negligent driver from a first-party contractual claim under your own auto policy. Why Is My Car Worth Less If It Was Properly Repaired? Consumers generally care about vehicle history. If two otherwise comparable vehicles are available for the same price, many buyers would prefer the one that has never sustained significant collision damage. Dealers understand this and may account for accident history when determining what they are willing to offer for a trade-in. A serious collision may raise concerns about: Previous structural or frame damage; Airbag deployment; Suspension or alignment damage; Replacement body panels; Paint work or color matching; Long-term mechanical reliability; Future corrosion or repair issues; Manufacturer warranty implications in some circumstances; The ability to resell the vehicle later; and The accident appearing on vehicle history reports. Even if none of those concerns ultimately causes a mechanical problem, buyers may still discount the vehicle because they perceive greater risk. Diminished value is therefore largely a marketplace issue. The question is not simply whether the car drives correctly. The question is what a knowledgeable buyer would reasonably pay for it now compared with what the same buyer would have paid before the accident. How Is Diminished Value Calculated? There is no single formula that accurately determines diminished value for every vehicle and every accident. Insurance companies sometimes use standardized formulas or internal estimating systems, but a formula is only as useful as the assumptions behind it. A luxury vehicle with low mileage and major structural repairs may experience a different market reaction than an older high-mileage vehicle that sustained minor cosmetic damage. A credible diminished value analysis may consider factors such as: The vehicle’s year, make, model, and trim; Pre-accident mileage; Pre-accident condition; Vehicle options and packages; Pre-accident market value; The severity and location of collision

When Policy Limits Cap Your Recovery, and What Can Be Done About It

A serious car accident can create losses that quickly exceed the amount of insurance carried by the driver who caused the crash. Emergency care, diagnostic testing, specialist treatment, rehabilitation, lost income, future medical needs, and the physical and emotional effects of an injury can add up to far more than an at-fault driver’s liability policy will pay. When that happens, accident victims often hear a frustrating phrase from the insurance company: “That’s the policy limit.” A policy limit is important, but it does not necessarily mean the investigation should stop. The limit generally defines the maximum amount a particular insurance policy will pay for a covered claim. It does not automatically determine the full value of the injured person’s damages, nor does it necessarily mean that no other insurance, responsible party, or source of recovery exists. For someone who has suffered a serious injury, the difference can be substantial. Before accepting a policy-limits settlement, a personal injury attorney should investigate the accident carefully, identify every potentially responsible party, review all available insurance policies, and determine whether additional avenues of recovery may exist. What Is an Auto Insurance Policy Limit? An insurance policy limit is the maximum amount an insurance company has agreed to pay under a particular coverage, subject to the terms, conditions, exclusions, and applicable law governing the policy. California’s standard minimum automobile liability limits are currently $30,000 for bodily injury or death to one person, $60,000 total for bodily injury or death to more than one person in a single accident, and $15,000 for property damage. Those numbers are often written as 30/60/15. The first number is generally the maximum bodily injury liability coverage available to one injured person. The second is the total bodily injury limit available to everyone injured in the same accident. The third applies to covered property damage. Drivers can purchase substantially higher limits, and many do. Policies may provide $50,000, $100,000, $250,000, $500,000, or more in bodily injury protection depending on the coverage purchased. Some individuals also carry umbrella or excess liability insurance providing additional protection above the underlying auto policy. The problem for an injury victim arises when the damages are greater than the insurance available. Can My Injury Claim Be Worth More Than the At-Fault Driver’s Policy Limit? Yes. The value of a personal injury claim and the amount of insurance coverage are separate questions. Suppose a negligent driver carries $30,000 in bodily injury coverage and causes a collision resulting in significant injuries. The injured person’s medical treatment, lost earnings, future care, pain, physical limitations, and other legally recoverable damages could potentially be worth substantially more than $30,000. The insurance company does not get to redefine those damages simply because its insured purchased a relatively small policy. Instead, the policy may restrict how much that particular insurer is contractually required to pay. This distinction is critical. A case should not automatically be evaluated as a “$30,000 case” merely because the negligent driver carries $30,000 in bodily injury insurance. The actual damages may be far greater. A lawyer handling a serious accident should therefore investigate both sides of the equation: the full value of the damages and all potential sources from which those damages may legally be recovered. What Happens When the At-Fault Driver Has Only Minimum Coverage? California increased its standard minimum auto liability requirements beginning in 2025. Even with those higher limits, a $30,000 per-person bodily injury limit can be inadequate for many significant injury claims. A hospitalization, fracture, surgery, traumatic brain injury, spinal injury, or prolonged course of rehabilitation can create losses far beyond that amount. When available liability insurance appears inadequate, several questions should be investigated: Is the disclosed policy actually the only applicable liability policy? Does the driver have another auto policy? Was the vehicle owned by someone other than the driver? Was the driver working at the time of the collision? Was the driver acting for a company or business? Was a rideshare, delivery, or commercial insurance policy potentially in effect? Does another responsible person or entity share fault for the collision? Does the injured person have uninsured or underinsured motorist coverage? Is there an umbrella or excess insurance policy? Are there viable assets or another legally collectible source if damages exceed insurance? Finding the answers can completely change the financial landscape of a case. Can Underinsured Motorist Coverage Help? Underinsured motorist coverage, commonly called UIM coverage, can be particularly important when the negligent driver’s insurance is insufficient. California insurers generally must offer uninsured and underinsured motorist coverage with an automobile liability policy, although a policyholder can reject that coverage in writing. UIM coverage is part of the injured person’s own insurance protection rather than coverage purchased by the driver who caused the accident. For example, an injured person might have significantly higher uninsured and underinsured motorist protection than the at-fault driver has liability coverage. Depending on the applicable policies and California insurance law, a UIM claim may provide another source of recovery after the available liability coverage is exhausted. However, UIM claims involve their own rules and calculations. They should not be treated as simply adding the full UIM policy limit on top of the other driver’s liability limit. The language of the policy, the available liability coverage, the damages, and California law all matter. This is one reason an attorney should obtain and analyze the complete insurance policies rather than relying solely on declarations pages or statements made by an adjuster over the phone. What If the Driver Who Hit Me Was Working? One of the most important investigations in a policy-limits case is determining what the negligent driver was doing when the crash occurred. If the driver was acting within the scope of employment or performing work for a business, additional legal and insurance issues may arise. Depending on the facts, an employer or other business entity may potentially bear responsibility for the employee’s negligence. That can mean access to a commercial liability policy with much higher limits than the driver’s personal

Bicycle Accident Lawyer San Diego

San Diego’s sunny weather and bike-friendly communities make cycling one of the most popular ways to commute, exercise, and enjoy the city. But with more bicycles on the road, the risk of accidents increases. When a crash occurs, the consequences can be life-changing. Victims face medical bills, lost income, and long recoveries—all while insurance companies try to minimize their claims.

If you or a loved one has been injured, you need a skilled bicycle accident lawyer San Diego who understands how to protect your rights and secure the compensation you deserve. At AK Injury Law Firm, led by Dr. Azadeh Keshavarz, we bring a unique blend of medical expertise and strategic legal advocacy to every case. Our mission is simple: Outthink, Outfight, Outwin.

Why You Need a Bicycle Accident Lawyer San Diego

Cyclists are some of the most vulnerable people on the road. Unlike drivers, they have no protective barrier, meaning even a minor collision can result in severe injuries. Unfortunately, insurance companies often try to shift blame onto the cyclist, arguing they weren’t visible, failed to follow traffic rules, or assumed the risk of riding.

Working with a bicycle accident lawyer San Diego ensures that:

  • Your rights are protected against unfair tactics.

  • The true value of your case is calculated, including long-term medical needs.

  • Liability is properly assigned to the negligent driver, company, or municipality.

  • Evidence is preserved before it can disappear.

The AK Injury Law Firm Advantage

Not all law firms are the same. At AK Injury Law Firm, we bring a different level of understanding to bicycle accident cases.

Medical Insight for Injury Cases

Before becoming a lawyer, Dr. Azadeh Keshavarz was a doctor of chiropractic. She knows how injuries such as spinal damage, whiplash, and chronic pain affect victims long after an accident. This dual perspective strengthens every case we take on.

Female-Owned, Client-First Approach

We pride ourselves on being a female-owned law firm that treats clients with compassion and respect. While we fight fiercely in negotiations and courtrooms, we never forget that real people and families are behind every case.

Outthink, Outfight, Outwin

Our firm’s slogan represents our philosophy. We don’t just fight hard—we fight smart. By anticipating insurance company strategies, we stay one step ahead and consistently deliver results.

Common Causes of Bicycle Accidents

In San Diego, bicycle accidents often occur because of:

  • Distracted drivers – Texting, eating, or failing to check blind spots.

  • Failure to yield – Cars not respecting cyclists’ right-of-way.

  • Doored accidents – Drivers opening car doors in bike lanes.

  • Speeding and reckless driving – Reduced reaction times put cyclists at risk.

  • Unsafe road conditions – Potholes, poor lighting, or lack of bike lanes.

  • Defective bicycles or parts – Brake failures or manufacturing defects.

An experienced bicycle accident lawyer San Diego investigates each factor to build a strong liability case.

Types of Bicycle Accident Injuries

Cyclists often suffer serious injuries that require long-term care. At AK Injury Law Firm, we represent clients with:

  • Traumatic brain injuries (TBI)

  • Broken bones and fractures

  • Spinal cord injuries and paralysis

  • Internal bleeding and organ damage

  • Severe lacerations and road rash

  • Soft tissue injuries

  • Chronic pain and reduced mobility

Because Dr. Keshavarz understands both the medical and legal sides of these injuries, she ensures that clients receive compensation reflecting their true recovery needs.

Compensation You May Be Entitled To

When you file a claim with the help of a bicycle accident lawyer San Diego, you may be able to recover compensation for:

  • Medical expenses (current and future care)

  • Lost wages from time off work

  • Reduced earning capacity if injuries affect your career

  • Pain and suffering

  • Emotional distress

  • Property damage to your bicycle and personal belongings

  • Loss of enjoyment of life

Steps to Take After a Bicycle Accident

The moments after a crash are overwhelming, but your actions can affect your case. Here’s what to do:

  1. Call 911 – Always get a police report.

  2. Seek medical treatment – Even if injuries seem minor, get checked.

  3. Document the scene – Take photos of your injuries, the car, and road conditions.

  4. Collect information – Get the driver’s details and witness contacts.

  5. Do not admit fault – Statements like “I’m fine” can hurt your claim later.

  6. Contact a lawyer – Reach out to a trusted bicycle accident lawyer San Diego before speaking to insurance adjusters.

How AK Injury Law Firm Builds Strong Cases

Every case we handle is built with precision and strategy. Our process includes:

  • Comprehensive investigation – Reviewing police reports, medical records, and accident footage.

  • Expert collaboration – Working with doctors, accident reconstructionists, and engineers.

  • Aggressive negotiation – Countering insurance companies’ lowball offers.

  • Trial readiness – Preparing every case as if it will go before a jury, which strengthens our settlement position.

Why Local Representation Matters

San Diego has unique roadways, cycling laws, and accident trends. Choosing a bicycle accident lawyer San Diego who knows the area provides an advantage:

  • Familiarity with San Diego courts and judges.

  • Knowledge of local cycling routes and accident hotspots.

  • Experience with insurers operating in Southern California.

Why Insurance Companies Fear AK Injury Law
